GSK Petition Threatens Weight Loss Supplements

Dear Dietary Supplement Industry Member,

As you may know, GlaxoSmithKline (GSK) has petitioned the FDA to classify weight loss claims for dietary supplements as disease claims. Many people say that this is nothing more than an attempt by the makers of alli™, the first over-the-counter weight loss drug, to quash competition from the supplement weight loss industry. Some say it is yet another instance of a pharmaceutical giant using its considerable resources for legal and political advantages against competing products in the supplements industry, products which are safer and produce fewer side-effects, yet are often as or more effective than their pharmaceutical counterparts.

This may have huge implications for not only the supplement weight loss industry, which is rapidly growing and estimated to currently be worth $1.3 billion in annual sales, but for the dietary supplements industry overall; some see it as another step in the overregulation of dietary supplements and attacks from big pharma, which, should FDA decide to rule in favor of GSK, some say could be a death knell for our industry.

The industry is abuzz with regards to this petition; some feel that we should defend weight loss supplements as they are an important category of product for our industry and are being attacked unfairly by a company with a questionable record of honesty. As you may know, the FDA recently issued a warning to GlaxoSmithKline for not reporting safety results on its diabetes pill Avandia. Previously, the Senate Finance Committee found that Glaxo Smith Kline intimidated and coerced a prominent critic of Avandia so that he would no longer speak critically of the drug. Just before that, it was alleged that the company systematically hid and manipulated data concerning Paxil-induced suicide in depressed adults.

Others in our industry believe that misleading advertising related to this category of supplements has become so egregious that companies selling the supplements deserve whatever actions may take place against them.

Personally, I have found eating raw uncooked foods has worked the best for me when it comes to weight loss. That said, I know there are also a number of good dietary supplements on the market such as Chitosan, for example, that will help people lose weight.GSK won't be able to regulate weight loss dietary supplements any more than they can regulate ANY supplements more than they already are unless they repeal DSHEA. The biggest threat to DSHEA is via regional harmonization coming via FDA's Trilateral Cooperation Charter with Canada and Mexico. Thats how FDA intends to usher Codex restrictions into N.America. Right now Canadians are facing the worst bill I've ever seen in C-51, (see www.stopc51.com ) and I am trying to kill it in the Canadian Parliament. If we fail to kill it, its coming to the USA via the Trilateral Cooperation Charter which is the harmonization mechanism that people in this industry are ignorantly ignoring. I have gotten FDA's internal documents on the Trilateral Cooperation Charter via the Freedom of Information Act and can prove they're creating one harmonized set of Food and Drug regs for Canada, US and Mexico as if a North American Union Dictatorship were already in place. I wish people in the US supplement industry would wake up while there is still time to push for congressional oversight on this. Google CODEX Alimenterius - It's all a planned scam coming to you in 2009 to take away ALL supplements and also force Monanto's growth hormone into EVERY living animal used as food. The corporate criminals want it all for themselves - including putting Organic farmers out of business. Wake up America.

Are we surprised? The FDA is bought and paid for by big pharma, when is the last time it appeared they had even the slightest bit of objectivity?? These attacks on our ability to make choices regarding our own health will continue until we revolt against an increasingly corrupt system. All Hail Capitalism!!

This is just another atempt by pharma companies to line their pockets even further. They have already managed to kill the weight loss industry with the banning of ephedra in weight loss products. Speaking as one that has had to battle weight problems for years, I speak from experience. Ephedra products actually helped. You can pour through all the data but FDA drugs out on the market now have higher numbers of adverse reactions than the ephedra products had. Get obesity classified by them as a disease, next here comes the insurance indusrty jacking rates up on people who are overweight. All these types of policies and changes have a domino effect. Big pharmacutical companies look at the sale numbers for the otc supplements and they start to drool about how much more they can be grossing. None of them actually care whether Americans are overweight or not just that they want more money. Check deeper I am sure that the AMMA is backing this some sort of way. Another reason to have to go to the doctor. A billion plus added rev for Pharma companies, how much more in medical expenses does that translate into for the medical instituations and the number of added uneeded test while your at the doctor. Like I said the domino effect. Just another Big Brother control attempt. We will all wind up having to ask Mother may I just to go to the restroom by the time Corporate owned America finishes with us.

I am a pharmacist and have found out that most of the pharmaceutical companies are trying to kill the Natural health industry but it will not work for them.Food supplements works and is safer than most drugs.GSK should adopt a better marketing strategy to sell their product and not trying to fight our industry.

Being fat and overweight is NOT a disease. It may lead to disease states, but in itself it is not a disease. GSK are being disingenuous. The FDA should tell them to take a hike. If their drug is any use supply and demand will do the rest.

Every inch that big pharma is allowed results in them taking a mile. Do not give in to even the least attempt at regulating supplements or they will regulate them out of our reach. Even if you don't currently use supplements you need to defend your right to choose that path when the time comes.

Obesity is a nutritional problem, the genetic componenet is less than 5% or so. It is a preventable, behavioral problem and is due to an imbalance between intake and ouput of energy. Any All scientists including medical doctors know this. Unfortunately patients tend to listen to doctors only even if they are not trained in nutritional diseases. While many physicians recognize that nutrition plays a critical role in eradicating most modern diseases or the diseases of the west, the pharmacological approach to medicine rather than a wholistic one continues to be politically what works for now. More and more patients are recognizing the fact that naturopathy is and should be a way of life to avoid side effects of long term usage of drugs. Andrew Weil, Deepak Chopra will be hailed in future as people who pioneered a naturopathic revolution in medicine. It is also interesteing that Naturopathic Schools are being accredited by the American Medical Association. Four such schools already exist driven by consumer and patient demand. It is not surprising that the pharma lobby is quick to get such proposals passed without the public becoming aware. I think we should strongly protest as Obesity was not even considered a medical to a couple of years ago. Only recently are they allowing weight loss medical visits to be reimbursed. We have seen a number of bariatric clinics mushroom as a consequence. I am all for defending our rights.
